Terms and Conditions

Online Auction: 8 Night Mekong River Cruise from Siem Reap to Cambodia

1. Promoter Details

The online auction is conducted by MyHoliday2 [KATPIN Pty Ltd] ABN 21159194484 (“the Promoter”).

By participating in this auction, bidders agree to be bound by these Terms and Conditions.

2. Auction Item

The auction item is one (1) cruise cabin for a voyage departing on 26 August 2026 aboard Tuom Tiou II, departing from Siem Reap, Cambodia.

The cabin category, itinerary, inclusions, exclusions, and applicable booking conditions are outlined in the auction listing.

The cruise booking is subject to the terms and conditions of the relevant cruise line, which will also apply to the successful bidder.

3. Auction Period

The auction opens on Friday 19th July at 9:00am AEST and closes at 11:59 pm AEST on 10 July 2026 

The Promoter reserves the right to extend, suspend, or cancel the auction at its sole discretion.

4. Eligibility

Participants must:

  • Be aged 18 years or older;
  • Reside in Australia or another jurisdiction approved by the Promoter;
  • Be legally capable of entering into binding contracts; and
  • Comply with all applicable laws and these Terms and Conditions.

Employees, contractors, and immediate family members of the Promoter may be excluded from participation.

5. Bidding Process

All bids must be submitted through the designated online auction platform

Each bid is considered a binding offer to purchase the cruise cabin.

Bidders are responsible for ensuring their bids are submitted before the Closing Date. The Promoter accepts no responsibility for technical issues, internet outages, or other circumstances that may prevent a bid from being received.

The highest valid bid received at the close of the auction will be deemed the winning bid.

In the event of a dispute regarding the winning bid, the Promoter’s decision is final.

5A. Reserve Price

The auction is subject to a reserve price of $1,500 AUD per cabin

The reserve price is the minimum amount the Promoter is willing to accept for the cruise cabin and will not be disclosed to bidders.

Submission of the highest bid does not automatically guarantee the sale of the cruise cabin. If the highest bid received at the close of the auction does not meet or exceed the reserve price, the Promoter reserves the right, at its sole discretion, to:

  • Decline all bids;
  • Negotiate with the highest bidder following the auction close;
  • Extend the auction period; or
  • Re-auction the cruise cabin at a later date.

Where the reserve price is met or exceeded, and the winning bidder complies with these Terms and Conditions, the Promoter agrees to complete the sale.

The Promoter reserves the right to remove, amend, or waive the reserve price at any time before the auction closes.

6. Payment Terms

The successful bidder will be notified within 24 hours of the auction closing.

Full payment must be made within 48 hours of notification unless otherwise agreed in writing by the Promoter.

Payment must be made using an approved payment method specified by the Promoter.

Failure to make payment within the required timeframe may result in:

  • Cancellation of the winning bid;
  • Forfeiture of any deposit paid; and
  • The Promoter offering the cabin to the next highest bidder or re-auctioning the item.

7. Booking and Passenger Details

The successful bidder must provide all required passenger information, including full names as shown on passports, dates of birth, contact details, and any other information required by the cruise line, no later than 15 July 2026.

The successful bidder is responsible for ensuring all passenger information is accurate.

Any costs arising from name changes, amendments, or corrections after booking confirmation will be the responsibility of the successful bidder.

8. Transferability and Changes

The cruise cabin may only be transferred, amended, or substituted if permitted under the cruise line’s booking conditions.

Any transfer, change, or amendment fees imposed by the cruise line or the Promoter are the responsibility of the successful bidder.

If the cruise line does not permit booking transfers, the winning bid is non-transferable.

9. Inclusions and Exclusions

The inclusions of the auction are as follows:

  • 1x Main deck cabin for 2 people on RV Toum Tiou II sailing on 28 Aug 2026;
  • 8x Breakfasts, 8x lunches, 8x dinners
  • ^Drinks package including wine, beer & soft drinks at meals times
  • Coffee, tea & drinking water
  • Shore excursions as outlined in the program
  • Services of English-speaking local tour guides
  • Port fees
  • Wifi

The following are excluded and are the sole responsibility of the successful bidder:

  • International flights
  • Pre- and post-cruise hotel accommodation
  • Airport and hotel transfers
  • Travel insurance
  • Fuel surcharges or airline-imposed surcharges (if applicable)
  • All-inclusive drinks package (unless specified in cruise inclusions)
  • Optional excursions
  • Cambodian and Vietnamese visas
  • Personal expenses
  • Tipping (recommended EUR€10 per person per day, payable to the Ship Manager for distribution among crew and service providers)
  • Meals, beverages, or services not specified as included by CroisiEurope
  • Any additional arrangements or services not forming part of the CroisiEurope Mekong River cruise itinerary
  • Anything not mentioned in inclusions

10. Travel Insurance

Comprehensive travel insurance is strongly recommended and remains the responsibility of the successful bidder.

11. Cancellations and Refunds

All sales are final.

No refunds, exchanges, or credits will be provided for change of mind, inability to travel, failure to obtain required travel documentation, or cancellation by the successful bidder.

If the cruise is cancelled or materially altered by the cruise line, any refund, credit, or alternative arrangements will be subject solely to the cruise line’s terms and conditions.

The Promoter accepts no liability for any costs incurred by the successful bidder arising from changes, delays, cancellations, or force majeure events.

12. Travel Requirements

The successful bidder is responsible for ensuring all travellers:

  • Hold valid passports with the required validity period;
  • Meet any visa, health, vaccination, or entry requirements; and
  • Comply with all cruise line policies and government regulations.

Failure to meet travel requirements does not entitle the successful bidder to a refund.

13. Limitation of Liability

To the maximum extent permitted by law, the Promoter excludes all liability for any loss, damage, injury, delay, expense, or inconvenience arising from participation in the auction or use of the cruise cabin.

Nothing in these Terms and Conditions excludes any rights or guarantees that cannot be excluded under the Australian Consumer Law.

14. Privacy

Personal information collected during the auction will be handled in accordance with the Promoter’s privacy policy and used for the purpose of administering the auction and facilitating the cruise booking.

15. Governing Law

These Terms and Conditions are governed by the laws of Queensland, Australia.

Any disputes arising from the auction shall be subject to the exclusive jurisdiction of the courts of Queensland.

16. Acceptance of Terms

By placing a bid, participants acknowledge that they have read, understood, and agreed to these Terms and Conditions.
